Please Read Carefully: It is advised to understand all terms and conditions of this Agreement and consult legal advice if necessary.

1. Agency Relationship: This Limited Representation Agreement between the Seller(s) and Realty Net, LLC, is represented in Oregon by Greg Messick, Principal Broker. Washington listings are referred to Quang Nguyen, Designated Broker (Washington).
   
   

2. Term: Effective upon signing, this Agreement extends to the earliest of its cancellation, the agreed expiration date, or the closing date if the Property is under contract.
   
   

3. Broker Services: Broker provides only services/products described in this Agreement and selected by the Seller. Additional services/products require a separate addendum and approval.
   
   

4. Broker Service Exclusions: Broker’s services exclude property showings, physical inspections/evaluations, and property pricing unless otherwise agreed.
   
   

5. Seller Obligations: Seller must ensure MLS compliance, accuracy of information, compliance with fair housing laws, notify Broker of changes, and provide sales agreement copies as requested.
   
   

6. Seller Acknowledgments/Representations/Warrants: Seller confirms legal title and authority to sell the Property, ensuring no other listing contract exists.
   
   

7. Required Seller Disclosures: Seller must execute all legally required disclosures, revealing material facts affecting the Property’s value.
   
   

8. Compensation:
   
   

   1. Flat Fee MLS Listings: No commission to the listing agent through escrow unless service level is upgraded.
      

   2. Agent Assist Packages: A $799 flat fee is paid from escrow.
      

   3. Discount Limited Full-Service Packages: Seller pays the commission as outlined in the purchased package.
      

   4. Buyer’s Agent Commission: Not obligatory. Traditionally 2.5% or a flat dollar amount. This commission incentivizes agents working with buyers.
      
      

9. Cancellation and Refund Policy: Seller can cancel with written notice if no contract is pending. Fees are non-refundable except under specific conditions outlined in this section.
   
   

10. Lockbox, Keys & Sales Materials: Seller uses these at their own risk and should obtain necessary insurance.
    
    

11. Seller's Contact Info on MLS and Public Websites: Seller’s contact information will not be displayed publicly; inquiries will be forwarded to the Seller.
    
    

12. Attorney’s Fees and Costs: Prevailing party in a dispute is entitled to reasonable attorney’s fees and costs.
    
    

13. Indemnity/Hold Harmless: Seller indemnifies and holds Broker harmless from claims arising from misrepresentations, document inaccuracies, or commission payments to cooperating brokers.
    
    

14. Modification: Modifications must be in writing and signed by both Seller and Broker.
    
    

15. Safety Clause: A 60-day safety clause protects any buyer's agent who introduced the Property to buyers. If within 60 days post-cancellation or expiration, the Property is sold to a buyer introduced by a buyer’s agent during the term, the Seller agrees to compensate the Broker as previously agreed. This clause does not apply if the Seller enters into another Listing Agreement with an Oregon Real Estate Agent within this period.
